The SPRITZER ‘My No.1 Moment’ Contest ("Contest") is organized by CHUAN SIN SDN BHD of Lot 898, Jalan Reservoir, Off Jalan Air Kuning, 34000 Taiping, PERAK.
1. Duration
1.1 The Contest shall be held from 15th October 2009 till 18th November 2009.
1.2 The contest is divided into 5 weeks. Each week, the contest begins on Thursday at 12.00am and end on Wednesday at 11.59pm.
1.3 Any entries received after 18th November 2009 (due to any reason howsoever and/or whatsoever arising) shall be disqualified.
2. Eligibility
2.1 The Contest is open to holders of valid email accounts in Malaysia only.
2.2 Employees and immediate family members of the Organizer, their advertising agencies, affiliates, subsidiaries, agencies and suppliers are not eligible to participate in the contest.
2.3 The Contestants must be citizens or permanent residents of Malaysia with a valid National Registration Identification Card ("NRIC") number (12-digit) at the time of participation of the Contest.
2.4 Contestants under the age of eighteen (18) must seek parental and/or guardian approval to participate.
3. Contest Mechanics
3.1 Contestants must attach their photographs in emails, and type in their names, 10-digit Spritzer contest code (THREE 600ml label codes or ONE 1500ml label code), new IC number, mobile phone number, photo description (in English, Bahasa Malaysia or Chinese only) and send to contest@spritzer.com.my

3.2 Photographs submitted for contest entry must be related to respective contestants and not taken from any unknown sources or image libraries.
3.3 One photograph per email entry. Photograph must not exceed 250kb and must be in JPEG format.
3.4 The 10-digit Spritzer Contest Code can be obtained from the label of participating Spritzer Natural Mineral Water (600ml and 1500ml) during the Contest Period. Each Spritzer Contest Code is only valid for ONE (1) entry.
3.5 Contestants may send more than one entry but each entry must be accompanied by a photo of ‘My No.1 Moment’ and valid unique code(s). Note: Each Spritzer Contest Code can only be used ONCE.
4. Contest Entries
4.1 The Contestant must ensure that their Contest entries are complete and accurate. Incomplete, illegible or late entries shall be disqualified.
4.2 The organizer reserves the right to reject any registration and/or entry at its sole and absolute discretion without having to assign any reasons whatsoever.
4.3 The Contestant can send in more than one entry throughout the entire contest period.
4.4 During the Contest Period, Contestants will be prompted to participate in the Contest via the various above the line media, print ads, press ads, flyers and also through SMS promotional campaigns.
4.5 Contestants shall retain the proof of purchase (Spritzer labels) from which the codes are used to enter the contest for verification by the organizer upon request.
5. Judging/Winning Criteria
5.1 The panel of judges will select weekly winners based on completeness, creativity, originality and relevancy of the photograph to the Contest’s theme.
5.2 Each contestant is entitled to win only one prize per week.
5.3 The Judge's decision is final and binding. No correspondence shall be entertained.
6. Notification of Contest Winners
6.1 Contest winners will be notified by telephone call to his/ her mobile phone or email for which the contact number shall be the number used by the Contestant for submission of the codes.
6.2 The organizer reserves the rights to use any other method or medium it deems fit at its sole and absolute discretion for the purpose of announcing the Contest winners.
6.3 Upon request, Contest winners will be required to give their contact details, copy of I.C. and any other details deemed necessary and relevant by the organizer at its discretion within forty eight (48) hours upon receiving the request/notification from the organizer.
6.4 Proof of mailing, faxing, or delivering (in any manner whatsoever) any details to the organizer does not denote proof that the organizer has received such details.
6.5 The organizer reserves the rights to forfeit prizes for any Contest winner who does not provide the required details upon receiving the request/notification.
6.6 The organizer reserves the right to appoint a third party to conduct the verification of Contest winners and to fulfill the delivery of prizes and Contestants agree that the organizer may provide all necessary information of Contest winners to such third party to facilitate such service.
7. Contest Prizes

7.2 The organizer reserves the right to change the prizes without any prior notification.
7.3 The Contest winner shall be responsible for all costs in connections with perfecting his/her prize, including but not limited to legal cost, stamp duties, registration and transfer fees, taxes, insurance, spending money and related expenses (such as meals or personal expenses, upgrades etc.) or fees.
7.4 Prizes not claimed within one month upon request/notification shall be forfeited. Prizes are not exchangeable, transferable or redeemable in any other form for whatever reason. Contest winners are solely responsible for the collection of their prize(s). The organizer and its agents, sponsors and representatives shall have no liability to the Contest winners in any respect whatsoever.
7.5 The organizer reserves the right to request written proof of residency and of the age of any Contest winner before the prize is dispatched or collected.
7.6 The organizer makes no warranties or representations whatsoever with respect to the prize and shall not be responsible nor liable for any problems and/or damage there to or arising there from.
7.7 Prizes must be claimed in person unless advises otherwise. Identification which includes a photograph will be required (examples include identification card/drivers license/passport which displays a photograph of the Contest winner).
7.8 Where the organizer elects to post a prize to a Contest winner no responsibility will be accepted by the organizer for the safe and effective postal delivery of the prize.
7.9 In special situations, and subject to the absolute discretion of the organizer, a Contest winner may nominate a designated representative to collect a prize. The representative will be required to present written authorization from the Contest winner and identification which includes a photograph for both the Contest winner and their representative.
7.10 In the event that a Contest winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of the organizer.
7.11 All prizes are accepted entirely at the risk of the Contest winner, and the organizer excludes all warranties in connection with any prize to the extent permitted by law. Contest winners shall comply with the terms and conditions of each prize.
7.12 All brands, names and trademarks associated with or used to describe the prizes are owned by their respective owners. The Organizers are not related to or associated with these parties in any way.
7.13 The Organizers reserve the right to forfeit the prizes if any Contest Winner fails to produce the Spritzer’s labels bearing the codes used to enter the contest and to disqualify the Contest Winner's entry.
8. Proof of Receipt
8.1 Proof of email sent by a Contestant does not denote proof that the email was received by the organizer.
9. Prize Giving Ceremony
9.1 In the event the organizer has a prize giving ceremony, the Contest winner(s) are required to attend at his/her own cost and expense to collect the prize. In the event the Contest winner is not able to attend the prize giving ceremony, the Contest winner must nominate a representative to be present at the prize giving ceremony to accept the prize on his/her behalf.
10. Publicity
10.1 The organizer reserves the right, at its sole and absolute discretion, to use the nicknames, names, photographs, voice or video recordings and entries of the Contest winner(s) and/or representatives without first obtaining any consent nor making any payment whatsoever to the Contest winner(s) and/or representatives for publicity, advertising, trade or promotion purposes in any media.
11. Adherence to Contest Terms & Conditions
11.1 In addition to these Terms and Conditions, instructions and methods of participating in the Contest, as set out on www.spritzer.com.my otherwise, shall also bind all Contestants and their participation in the Contest.
11.2 In the event of any conflict between these Terms and Conditions and any terms contained in any promotional material for this Contest, the terms contained herein shall apply.
11.3 Failure to comply with the rules, regulations, instructions or methods will result in the Contestants being disqualified.
11.4 By participating in this Contest, the Contestant is taken to have read and agreed to the terms and conditions herein and shall adhere to all and/or any decisions made by the Organizer.
12. Variation to the Terms & Conditions
12.1 The organizer reserves the right to change, amend, delete or add to these Contest Terms and Conditions without prior notice at any time and the Contestants shall be bound to such changes.
13. Liability
13.1 The organizer will not be responsible or liable for:
13.1.1 any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending an email as a result of any network, communication or system error, interruption and/or failure experienced by the participating mobile phone operators and/or by the organizer and/or resulting from participation or the downloading of any materials in the Contest. In the event of such error, interruption and/or failure, the organizer shall not be responsible or liable for any failure by any Contestant to participate in the Contest at any time.
13.1.2 any problem, damage or loss of whatsoever nature to any Contestant, or their authorized representatives resulting from their participation in the Contest.
13.1.3 any error (including error in notification of Contest winners), omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.
13.2 The Contest is provided on an "as is where is available" basis. The Organizer will not be responsible and will not be liable if any entry is lost, late or undelivered due to any reason other than the sole negligence of the Organizer. Proof of delivery of entries is not proof that the entries were duly received.
13.3 These terms and conditions are governed by Malaysian law and any dispute arising out of or in connection with them shall be subject to the exclusive jurisdiction of the Malaysian Courts. The Judges have the rights to amend the Terms and Conditions at any point.
13.4 The Organizer, its partners and its sponsors shall not be held responsible for any late, lost, incomplete or misdirected entries, computer system, phone line, electronic equipment, computer hardware, software and program malfunctions or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature or for problems in downloading email entries or for any other technical problems related to email entries.
13.5 The Organizer and its sponsors are not responsible for any incorrect or inaccurate entry information, whether caused by its subscribers or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the entries in the Contest.
14. Disqualification
14.1 The organizer reserves the right at its sole discretion to disqualify any individual that it determines to be tampering with the entry process or the operation of the Contest, to be acting in breach or potential breach of these Contest Terms and Conditions and/or the organizer's Website Terms of Use and Notices. No correspondence shall be entertained.
15. Suspension
15.1 The organizer further reserves the right to cancel, modify, suspend or delay the Contest in the event of unforeseen circumstances beyond its reasonable control.
